A Deputy's Next Decision.
As a Legal Deputy, decisions carry significant responsibility, balancing a person's safety, wellbeing, finances and legal best interests.
One of the most challenging situations arises when concerns are raised about a care home placement.
Perhaps you've been notified of repeated falls. A safeguarding concern has been reported. Family members are questioning the quality of care. Hospital admissions are becoming more frequent. Or perhaps the care home itself has advised that it can no longer safely meet the person's needs.
At that point, an important question arises:Is this a poor-quality service, or has the person's needs simply progressed beyond what the home can reasonably provide?
The answer is not always obvious.
Understanding the Difference
As people become frailer, their needs naturally change. A residential care home that was entirely appropriate six months ago may no longer be able to safely support someone whose nursing, behavioural or complex clinical needs have increased.
This does not automatically mean the home has failed.
Equally, repeated incidents should never simply be accepted as "inevitable."
Distinguishing between the progression of illness and avoidable shortcomings in care requires professional evaluation.
When Should a Deputy Seek Independent Advice?
Every situation is different, but an independent review may be valuable where:
A resident experiences repeated falls or frequent hospital admissions.
The care home advises it may no longer be able to meet the person's needs.
Safeguarding concerns have been raised.
Family members express concerns about standards of care.
There are disagreements between professionals about the most appropriate placement.
Significant changes in behaviour or health occur without a clear explanation.
A move to nursing care or specialist provision is being considered.
These are complex decisions that deserve careful consideration rather than assumptions.
Looking Beyond the Incident
For example, a resident who has experienced several falls may appear to require an immediate move to another service.
However, an experienced clinical reviewer would investigate key areas;
Has a comprehensive falls risk assessment been completed, updated and planned care adapted accordingly?
Have medications been reviewed to identify drugs that increase falls risk?
Has the GP undertaken appropriate investigations?
Have staff identified behaviours or lifestyle patterns such as poor fluid intake that may be a contributing to the risk? If so, what have they done about this?
Have active infections, dehydration, pain, delirium or other medical causes been excluded?
Have physiotherapy, occupational therapy or specialist referrals been considered?
Have previous interventions been monitored and evaluated?
Has a referral been made to NHS Falls Clinic and other appropriate support services?
Do MCA care plans and best interest decisions reflect the falls reality?
